Draft Resolution (M-4794) Regarding the Level of Public Utilities Commission Transportation Reimbursement Account Fees to be Imposed for Fiscal year 1999-2000 Pursuant to Public Utilities Code Section 421 (added 1983, Chapter 323), the Commission is required to annually determine a fee to be paid by every passenger stage corporation, charter party carrier of passengers, pipeline corporation, for-hire vessel operator, common carrier vessel operator, railroad corporation, and commercial air operators and every other common carrier and related business subject to the jurisdiction of the Commission, except as provided in Section 431 (other public utilities). The annual fee shall be established to produce a total amount equal to the amount established in the authorized Commission budget to support the Commission's regulatory activities for the class from which the fee is collected, including adjustments for increases in employee compensation, other increases appropriated by the Legislature, and an appropriate reserve, less the amount to be paid from special accounts or funds pursuant to Public Utilities Code Section 403, reimbursements, federal funds, other revenues, and unencumbered funds from the preceding year. The staff's proposed resolution will continue the fees at the same levels fixed for the current (1998-99) fiscal year for passenger vehicle operators, vessel operators, commercial air operators and pipeline corporations. Summary: On June 22, 1999, James Tobin, attorney for Pac- West Telecomm, Inc. (Pac-West), met with Cmmr. Hyatt in San Francisco. Also present was Wally Griffin, Chief Executive Officer of Pac-West. Griffin explained that Pac-West has invested $100 million in California and is growing its business to include local, long distance, and equipment services for small and medium business. Tobin stated that even though the Federal Communication Commission has determined that traffic to Internet Services Providers is jurisdictionally interstate, that finding does not prevent this Commission from treating this traffic as local for compensation purposes. He further stated that the Neeper Alternate was not capable of implementation because it does not identify any contract provisions to be inserted into the arbitrated agreement to replace the proposals of the parties which are rejected.
