Town Hall Meeting June 30, 1999 Casa Familiar 6 pm 212 West Park Avenue San Ysidro CPUC Commissioner Josiah Neeper will hold an open forum on telecommunications marketing abuses affecting Spanish- speaking consumers in the San Ysidro area. The purpose of the meeting is to provide the Hispanic community an opportunity to learn about such marketing abuses as slamming and cramming, and to express their concerns. Commissioner Neeper scheduled the meeting as a result of discussions with Hispanic community leaders. He will welcome comments from all consumers on these and related issues. Draft Resolution (M-4794) Regarding the Level of Public Utilities Commission Transportation Reimbursement Account Fees to be Imposed for Fiscal year 1999-2000 Pursuant to Public Utilities Code Section 421 (added 1983, Chapter 323), the Commission is required to annually determine a fee to be paid by every passenger stage corporation, charter party carrier of passengers, pipeline corporation, for-hire vessel operator, common carrier vessel operator, railroad corporation, and commercial air operators and every other common carrier and related business subject to the jurisdiction of the Commission, except as provided in Section 431 (other public utilities). The annual fee shall be established to produce a total amount equal to the amount established in the authorized Commission budget to support the Commission's regulatory activities for the class from which the fee is collected, including adjustments for increases in employee compensation, other increases appropriated by the Legislature, and an appropriate reserve, less the amount to be paid from special accounts or funds pursuant to Public Utilities Code Section 403, reimbursements, federal funds, other revenues, and unencumbered funds from the preceding year. The staff's proposed resolution will continue the fees at the same levels fixed for the current (1998-99) fiscal year for passenger vehicle operators, vessel operators, commercial air operators and pipeline corporations. Section 5003.2 of the PU Code further provides that the Commission may raise the fee imposed by Section 5003.1 up to a maximum of one-half of 1 percent of gross operating revenue if the Commission decides this increase is necessary to maintain adequate financing for the Transportation Rate Fund. The ICG representatives stated that, even if it were necessary to revise D98-10-057 in light of the Federal Communications Commission's February 25, 1999 declaratory ruling regarding ISP-bound traffic, the Commission could make such revisions without changing the result of D98-10-057, which was consistent with the declaratory ruling.
