Duque, in San Francisco. Also present were Michelle Cooke, advisor to Cmmr. Duque; as well as most interested parties and several observers. Schoonyan addressed the issues raised by the Administrative Law Judge’s Draft Decision (DD), and indicated Edison’s agreement with Cmmr. Neeper’s memorandum stating the Pilot Program for Forward Purchases for bidding into the Power Exchange/Independent System Operator (PX/ISO) markets (Pilot) did not violate the Commissions Preferred Policy (PPD). Schoonyan expressed Edison’s concern that the language reaches beyond the Pilot and if left uncorrected, would preclude transactions involving existing practices that clearly benefit Californians. Schoonyan provided several examples of transactions which have been used previously, but would be foreclosed by the DD. Schoonyan indicated the PPD required utilities to divest 50% of its gas-fired generation in order to mitigate market power concerns, but Edison divested 100% of its units, or about 5,000 MW more than was required. Schoonyan stated that the results of the market power assessment performed by the independent ISO/PX Market Monitoring and Surveillance Committees indicated that market power concerns were a generator problem, not a buyer concern and that it was reported that consumers paid $500 million more for power solely due to the generators abuse of their market power. Schoonyan indicated that Edison’s Pilot is being proposed to help mitigate these adverse impacts by generators, and provide lower future electricity costs to Edison’s full service customers. The parties noted that the Office of Ratepayer Advocates had filed a Motion to Strike McCallion’s rebuttal testimony on the Collaborative, as well as the Community Collaborative Agreement itself, taking the position that the agreement should instead be placed before the Commission as an amendment to the Application. The parties recommended that the Commission deny the motion, because it would delay the hearing, and the Agreement and testimony could not have been part of the applicants’ direct testimony because the Agreement was not reached until June, 1999. Summary: On July 7, 1999, Bruce Foster, Vice President of Regulatory Affairs for Southern California Edison Company (Edison), met with Cmmr. Hyatt in San Francisco. Also present was Gary Schoonyan, Director of Regulatory Affairs for Edison. Referring to the draft decision regarding a Pilot Program for Forward Purchases (Pilot), Foster indicated that a “no” vote meant that the Commission would proceed with hearings to ascertain the facts necessary to make an informed decision on many issues, including the market power, and price transperancy issues the ALJ used as the basis for the dismissal of the application. Schoonyan expressed Edison’s concern that the language over-reaches beyond the Pilot and would preclude transactions involving existing practices that clearly benefit Californians. With regard to market power concerns raised by the ALJ, Schoonyan indicated that the preferred policy decision required utilities to divest 50% of its gas-fired generation in order to mitigate market power concerns, but that Edison divested about 5,000 MW more. Schoonyan stated that the results of the market power assessment by the Independent System Operator/Power Exchange (PX) Market Monitoring and Surveillance Committees, indicated that market power concerns were a generator problem and that consumers paid about $500 million more for power solely due to the generator’s abuse. Schoonyan explained that Edison’s Pilot is being proposed to help mitigate these adverse impacts. Regarding price transperency, Schoonyan stated that nothing changes from what exists today and there is no price transparency issue with the Pilot. Schoonyan noted that those who advocated that the Pilot was “detrimental to the market”, were mainly generators and marketers, who tend benefit from the higher market prices that would result without the Pilot. Duque, Hyatt, Neeper and Wood. The letter demonstrates the fundamental flaws and unfairness of the Office of Ratepayer Advocates’ planned Section 314.5 audit of Pacific Bell. The letter asks the Commission to re-evaluate the public interest benefit of conducting any audit of Pacific Bell at this time. The letter states that if the Commission should find that an audit should be performed, responsibility for the audit should be transferred to the Telecommunications Division, the contract with Overland Consulting should be cancelled and the process should be begun anew. Duque, at the Opera Plaza in San Francisco. Finkelstein stated that TURN had originally been concerned that the proposed “flat rate” for certain business customers might create revenue shortfalls and that, after receiving further information from Southern California Edison (Edison), TURN was satisfied that the company proposed to avoid such shortfalls. Finkelstein explained, referring to a proposal in the 1999 Rate Design Window that would allow certain oil pumping customers to migrate from their current tariffs to a time-of-use water pumping tariff, that TURN has confirmed through data requests that this migration would result in shortfalls in the collection of the competition transition charge (CTC) and distribution revenue from these customers. Finkelstein stated further that this would shift the CTC collection away from these customers to Edison’s remaining customers; and make it less likely that Edison’s distribution revenues would be in the sharing range under the company’s distribution performance-based ratemaking mechanism. Finkelstein added that this shortfall should not be allowed to adversely impact Edison’s other customers under any circumstance.
