Severy indicated that current prices for inputs competitors require from incumbent local phone companies have been far too high to permit economical entry. Severy suggested that changes in the UNE prices contained in the ALJ's Proposed Decision (PD) are required before new entrants can serve residential customers on an economically viable basis. Severy explained that the UNE prices that competitors would pay under the PD exceed the incumbent's current retail revenues, thus preventing competitive local exchange carriers from being able to compete. Severy added that because proper imputation of the high UNE prices, as required by the PD, would result in an increase in Pacific Bell's retail rates, the Commission can either pursue that option, or lower UNE prices, especially for switching and the loop, to more cost-based levels. Harrelson stated that if the Commission does not set geographically deaveraged loop rates immediately, in the interim the Commission could apply a $2.64 universal service offset for residential unbundled loops to eliminate a discrimination problem acknowledged by the ALJ and the parties. Harrelson recommended, noting that the proposed 19% shared and common cost mark-up is the highest in the nation, that the Commission not impose this mark-up on residential loops, as the Federal Communications Commission suggested.
