Summary: On July 29, 1999, James Scarff, attorney for the Office of Ratepayer Advocates (ORA), met with Michelle Cooke, advisor to Cmmr. Duque, in San Francisco. Scarff stated that the negotiations between Southern California Gas Company and ORA on the market valuation of Southern California Edison Company's hydro assets were ongoing, but that resolution of all the issues appeared less likely to ORA at this time. Scarff explained that scheduling additional round of testimony and hearings after the end of the legislative sessions might serve some purpose if these hearings could function in information gathering that would inform the debate both here and at the legislature. Scarff noted that new information regarding market power problems and environmental needs had become known to stakeholders since they submitted their direct testimony. Scarff added that the following major issues should be resolved prior to any further testimony: The applicability of any decision in the docket to Pacific Gas and Electric Company, who claims that it is no longer an applicant and thus any decision would not apply to it; and, ORA's argument that any principles regarding market valuation of retained assets should also be applied to nuclear generating assets.
