Foster and Hoover explained SCE's opposition to the draft decision (DD), stating that: The DD fails to recognize that the primary concerns discussed by the Commission in D96-08-025 were resolved with the adopted ratemaking treatment, which aligned the interests of ratepayers and shareholders; with respect to the December 31, 1999 sunset date for the execution of new FPO agreements, the concern related to `the uncertainties over how unbundling, performance based ratemaking (PBR) and other aspects of the restructured electric industry will develop" has also been resolved, D97-08-056 adopted SCE's proposal to adapt the FPOs to unbundling and direct access and found that "there are no impediments to making these options available to direct access customers."; the DD fails to recognize that the ratemaking and sales impacts are excluded from SCE's PBR; the DD finds that SCE failed to meet its burden of proof stating that "SCE does not adequately address the impact of flexible pricing options on competition .", which ignores the fact that the FPO decision found SCE's proposed generic contracts are neither anticompetitive nor discriminatory; the DD also ignores the unbundling decision that found that all direct access customers can take advantage of the FPOs.; the DD would close rate options that existed prior to June 10, 1996, violating AB 1890 and would be inconsistent with D97-12-044. The EGA representatives indicated that EGA's proposal for a single, Semptra-wide gas transportation rate for electric generation customers solves the anticompetitive problems presented by SDG&E's proposed IB tariff and mitigates negative effects arising from existing discrepancies in regulatory pricing schemes.
