Stakeholder Roundtable on CPUC Innovations October 12, 1999 1 pm California Public Utilities Commission 505 Van Ness Avenue Auditorium San Francisco (Corner of Van Ness Avenue and McAllister Street) The Stakeholder Roundtable is a key element of our ongoing effort to assure that the way the California Public Utilities Commission (CPUC) conducts business is fully aligned with evolving publicly-valued needs and expectations. Federal and state utility deregulation, technological change, as well as other current issues with widespread impact including area code proliferation, local and long distance telephone competition, competition in electricity services, and the need for consumer education and protection in competitive industries. All of these make it imperative for the CPUC to continue to strive to address stakeholder and public needs in innovative and efficient ways. The goal of the Stakeholder Roundtable is to hear your suggestions for specific, feasible, needed innovations at the CPUC with respect to, for instance, changes in processes, rules, ways of conducting business, and ways we interact and communicate with the public and others. We also seek ideas from our employees on how we can make the Commission a more fulfilling place to work. Recently, the Commission issued its Draft 1999 - 2000 CPUC Business Plan for stakeholder review and comment (available at www.cpuc.ca.gov). Within it are ongoing process reform efforts, planned innovations in expanded electronic access to the CPUC, and additional planned streamlined procedures to benefit stakeholders and the public directly. The Draft Business Plan incorporates a set of eight good government initiatives I proposed this spring and the Directors' responses to an innovation survey conducted by the Governor's Office of Innovation in Government. These documents are available on the Commission website in association with this notice. The Stakeholder Roundtable is intended to go a step further by enabling us to hear firsthand from electric, telephone, and gas utilities and providers, rail, water, transportation, and other regulated entities. We also seek input from the public, consumer groups, industry labor representatives, legislators, the Administration, other government agencies, employee advocacy groups and employee union representatives about innovations or improvements you think we should make to better serve public and stakeholder interests, and how we should begin to implement them expeditiously. Contact Garret Shean at 415-703-1114; 916-327-1416, or GShean@cpuc.ca.gov by September 13th if you wish to be a Stakeholder Roundtable participant. Submission Instructions for Stakeholder Roundtable: As a starting point, the Roundtable will consider: Where are we now? Where should we be? How do we get there? In asking, "Where should we be?" the Commissioners seek constructive ideas on making the agency effective, efficient, and future-oriented. Areas for discussion might include, for example: New or evolving regulatory models for the Commission's regulatory, oversight, education, consumer protection, and enforcement roles; Communication, both to and from the Commission, and access to Commission information, focusing on ease of use, availability of information or employees, and the timeliness and value of available information; Electronic interfacing between the Commission and stakeholders, and e-business processes including the transferring information to and sharing of databases; The development of expert systems or automated processes for repetitive business processes; and Feedback mechanisms to continuously inform the Commission of a need to re-align its processes to address changing circumstances or enhanced technology. Responses: The Commission requests that stakeholder responses be submitted electronically at Gshean@cpuc.ca.gov. Internal PUC submissions are to GPS on Outlook. Hardcopy submissions may be mailed to Mr. Shean, Room 5119, 505 Van Ness Avenue, San Francisco, California 94102 The Commission requests that all potential participants provide on or before September 20, 1999, a one-page summary of their innovation suggestions so that they can be compiled into general topic areas for panel selection and circulated electronically to participants prior to the Roundtable to facilitate a valuable dialogue. An agenda, including a designation of topic panels, for the Roundtable will be returned to all respondents on October 5, 1999. Non- panel participants may address the Roundtable during a general comment period. Following the initial Roundtable, staff teams will review the replies, conduct any needed public workshops to discuss comments on stakeholder suggestions, and prepare an implementation plan for Commission consideration. Summary: On August 25, 1999, Thomas Long, Senior Telecommunications Attorney, for The Utility Reform Network (TURN), met with Lester Wong, advisor to Cmmr. Bilas. Also present was: Paul Stein, Staff Attorney, for TURN. A handout (attached to the notice) which summarized TURN's objection was provided. TURN argued against the Proposed Decision (PD) of ALJ Galvin. for the following reasons: 1) PD's rejection of revenue neutrality would weaken the efficiency incentives built into the New Regulatory Framework (NRF) and allow Pacific Bell (Pacific) to raise profits by increasing rates for a noncompetitive services; 2) PD's recommended price increase to .50 cents for directory assistance (DA) violates basic principles of NRF regulation and would result in pricing gouging; 3) PD fails to give sufficient weight to the unprecedented amount and fervor of public opposition to the proposed price increases; 4) PD's analysis of the cost providing DA relies on unsupported claims by Pacific and ignores more credible evidence that DA costs are decreasing; 5) PD improperly ignores the impact on basic service resulting from the recommended reduction of the DA call allowance. Myers and Miller both stated EID's and PG&E support's the alternate pages of Cmmr. Duque incorporated in the Proposed Decision (PD) of ALJ Barnett. Myers and Miller also stated issuance of construction to restore water facilities. Myers opposed the ALJ's $2 million adjustment to the $17 million rate recovery. Meiss stated that the Commission has never decided whether to separate electric generating assets for California Transportation Commission from water utility assets for ratemaking purposes. Maggard noted that cost of the El Dorado Hydroelectric Project (Project) have been part of electric rates and water revenue considered as electric other operating revenues. Meiss stated that PG&E electric ratepayers would be advantaged by transferring the facilities to EID, rather than rebuilding the damaged Project. Miller asked that Ordering Paragraph 4, requiring PG&E's Board of Directors assure the Commission that PG&E will not ask for decommissioning costs be changed to a letter from PG&E's Chief Executive Officer. Summary: AUGMENTATION REQUIRED. On August 26, 1999, William L. Reed, Vice President, Regulatory Affairs for Sempra Energy (Sempra), participated in an All-Party meeting with Cmmr. Hyatt and Cmmr. Wood, in San Francisco. Also present were: Kim Malcolm, advisor for Cmmr. Hyatt; Kevin P. Coughlan, advisor for Cmmr. Wood; Edwin A. Guiles, President for San Diego Gas & Electric (SDG&E); representatives from NRDC, UCAN, CUE, ORA; Pacific Gas and Electric Company; and additional representatives of Sempra. Reed spoke in favor of the rate indexing methodology. Reed stated that competition was to real drivers of energy sales, not the distribution company. Reed further stated that the revenue-per-customer mechanism could bring environmental consequences. Guiles also supported rate indexing to provide the eight incentive to SDG&E and denied any lead-building programs. Summary: On August 31, 1999, Richard B. Severy, Director of Public Policy, for MCI WorldCom Inc., (MCI WorldCom), sent a letter to Cmmr. Hyatt with attachment entitled "Calculation of `Common' Cost Markup." On the same day, the same letter without attachment was sent to Robert Lane, advisor to Cmmr. Hyatt. Severy pointed out that the Revised Proposed Decision (PD) fails to propose sound policy choices that will foster market entry and create the conditions needed to bring the benefits of local competition to residential customers. He further pointed out that because the proposed prices for the unbundled elements necessary for competitors to provide basic residential local service are too high, resulting in an untenable "price squeeze." Severy addressed MCI WorldCom's most serious concerns in the Revised PD, notably its treatment of the issues of shared and common costs, Yellow Pages and universal service credit. A copy of the letter is attached to the notice. Harrelson, Senior counsel for WorldCom Technologies, Inc. (MFSW), met with Cmmr. Bilas, in San Francisco. Written Materials was provided and is attached to the notice. Also present were: Lester Wong, advisor to Cmmr. Bilas; Eric A. Artman, Vice President-Industry Relations State Regulatory Policy, for MFWS. Harrelson explained that there were two issues decided in the Final Arbitrator's Report (FAR). In the alternative, Harrelson asked that the coformed agreement be rejected. Harrelson asked to adopt the Draft Arbitrator's Report dispositions of the issue: 1) providing for reciprocal compensation; 2) providing that prices paid for collocation pursuant to Pacific Bell's tariffs be made subject to refund. Harrelson briefly stated that the collocation prices in the conformed agreement needed to be subject to true-up and refund. Artman stated that the FAR's disposition of the issue did not comply with the Act and Federal Communication Commission (FCC) rules. Artman and Harrelson discussed the Act requires that compensation between an incumbent local exchange carrier and a competitive local exchange company (CLEC) be symmetrical. Artman stated that the FAR's provision that MFSW would receive only the end office switching element of Pacific Bell's reciprocal compensation prices. Artman explained that FCC did not want to require CLECs to produce cost studies. Harrelson and Artman described the architecture and functions provided by the MFSW network. Summary: On August 31, 1999, Timothy McCallion, Regulatory & Governmental Affairs Vice President-West, for GTE California Incorporated (GTE), met with Cmmr. Bilas, in San Francisco.. Also present were: Lester Wong, advisor to Cmmr. Bilas; Jenny Wong, Director-Regulatory Affairs, and Carol Fisher, Staff Administrator-Regulatory Affairs, for GTE. Fisher indicated that if the 310 overlay is reversed and returned to 7-digit dialing as requested in Assemblyman Knox' Petition to Modify D98-05-021, it would create tremendous customer confusion. Fisher further indicated that any delay in the implementation of area code relief such as number pooling will result number exhaust, violate Federal Communication Commission (FCC) rules. GTE representatives explained that implementation of number pooling requires significant changes. GTE representatives urged the Cmmr. Bilas to support the proposed draft decision on the 310 that would allow implementation of the new 424 overlay area code.
