Stakeholder Roundtable on CPUC Innovations October 12, 1999 1 pm California Public Utilities Commission 505 Van Ness Avenue Auditorium San Francisco (Corner of Van Ness Avenue and McAllister Street) The Stakeholder Roundtable is a key element of our ongoing effort to assure that the way the California Public Utilities Commission (CPUC) conducts business is fully aligned with evolving publicly-valued needs and expectations. Federal and state utility deregulation, technological change, as well as other current issues with widespread impact including area code proliferation, local and long distance telephone competition, competition in electricity services, and the need for consumer education and protection in competitive industries. All of these make it imperative for the CPUC to continue to strive to address stakeholder and public needs in innovative and efficient ways. The goal of the Stakeholder Roundtable is to hear your suggestions for specific, feasible, needed innovations at the CPUC with respect to, for instance, changes in processes, rules, ways of conducting business, and ways we interact and communicate with the public and others. We also seek ideas from our employees on how we can make the Commission a more fulfilling place to work. Recently, the Commission issued its Draft 1999 - 2000 CPUC Business Plan for stakeholder review and comment (available at www.cpuc.ca.gov). Within it are ongoing process reform efforts, planned innovations in expanded electronic access to the CPUC, and additional planned streamlined procedures to benefit stakeholders and the public directly. The Draft Business Plan incorporates a set of eight good government initiatives I proposed this spring and the Directors' responses to an innovation survey conducted by the Governor's Office of Innovation in Government. These documents are available on the Commission website in association with this notice. The Stakeholder Roundtable is intended to go a step further by enabling us to hear firsthand from electric, telephone, and gas utilities and providers, rail, water, transportation, and other regulated entities. We also seek input from the public, consumer groups, industry labor representatives, legislators, the Administration, other government agencies, employee advocacy groups and employee union representatives about innovations or improvements you think we should make to better serve public and stakeholder interests, and how we should begin to implement them expeditiously. Areas for discussion might include, for example: New or evolving regulatory models for the Commission's regulatory, oversight, education, consumer protection, and enforcement roles; Communication, both to and from the Commission, and access to Commission information, focusing on ease of use, availability of information or employees, and the timeliness and value of available information; Electronic interfacing between the Commission and stakeholders, and e-business processes including the transferring information to and sharing of databases; The development of expert systems or automated processes for repetitive business processes; and Feedback mechanisms to continuously inform the Commission of a need to re-align its processes to address changing circumstances or enhanced technology. NOTICE OF DRAFT RESOLUTIONS (Pursuant to PU Code  311(g)) Draft Resolution Authorizing Passenger Stage Corporations To Temporarily Adjust Fares Available For Public Review And Comment A draft resolution (TL-18904) of the Rail Safety and Carriers Division that gives passenger stage corporations (PSCs) temporary authority to adjust their fares without specific Commission authorization will be on the October 21, 1999 Commission meeting agenda. The Commission may vote on this resolution at that time, or it may postpone a vote until later. When the Commission votes on Resolution TL-18904, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare a different resolution. The resolution was drafted in response to the significant increases in fuel prices that have been experience by PSCs. It authorizes PSCs for a 180-day period to raise their fares as much as 15% above their current fares or, for those carriers who have been granted a zone of rate freedom (ZORF), 15% above the upper limit of the ZORF. The draft resolution is available for review and comment. Foster and Hoover (SCE representatives) explained that the revised draft decision of ALJ Gottstein provides a continuation of the Flexible Pricing Options (FPOs), even though on its face it would deny SCE's petition to modify D.96-08-025. SCE representatives noted that an extension beyond March 31, 2000 was contingent upon SCE filing for a continuation of the FPOs in the global, post-transition rate design. SCE representatives indicated that the extension requested was through the end of the rate freeze period and that the revised decision provides an incentive to file for a continuation of the FPOs. Wood. Also present during the meeting were Jasmin Ansar, Director, Regulatory Analysis, and Dr. Mark Schankerman, consultant, both for PG&E. A one-page handout titled "PG&E Distribution PBR," was used and attached to the notice. Schankerman stated that the important design features of a performance based ratemaking (PBR) mechanism include a starting point for rates (PG&E's pending GRC), that covers reasonable costs, unbiased benchmarks for key escalation parameters, symmetric sharing of risks, and competitive symmetry for all market participants. Schankerman described PG&E's proposal as a hybrid of the rate index and revenue per customer index mechanisms. Schankerman stated that PG&E's proposal would provide a rate index for larger customers who seek price stability, and revenue per customer index to promote energy efficiency and bill stability. Corey stated that the deferral of consideration of the interim PBR mechanism, given the delayed issuance of the GRC proposed decision, may, in essence, deny PG&E an opportunity to have an interim mechanism in place for January 1, 2000. TURN explained that the proposed decision of the administrative law judge to raise the price of directory assistance (DA) calls to $.50 cents and reduce the DA call allowances should not be adopted. TURN further explained that allowing a rate increase without ordering offsetting rate reductions through a surcredit would damage the efficiency incentives established by the New Regulatory Framework. ORA stated that the proposed decision (PD) failed to account for the public protest or impact of Pacific Bell's application. ORA stated that the proposed decision would adversely impact residential subscribers of Pacific Bell's local exchange service. ORA stated that the PD's findings also modify a prior Commission decision, which ordered NRF ILECs to provide five monthly directory assistance (DA) allowances until the development of a marketplace for local exchange DA. ORA stated that the PD's statement that 80% of residential subscribers make less than three DA calls per month is misleading estimate by Pacific Bell. Finally, ORA stated that if the Commission decides to ignore the flaws in Pacific Bell's cost assertions, the Commission should increase Pacific Bell's price ceiling for DA to no greater than $0.35. Hubbard stated that Southern California Gas (SoCal) and San Diego and Gas Electric Company (SDG&E) had a number of concerns with the Proposed Decision and asked to consider an alternate decision. Hubbard stated that SoCal/SDG&E intended to address, at the Oral Arguments scheduled for September 13, 1999, their beliefs regarding the adequacy of the record in support of their application. Ward stated that SoCal/SDG&E had recently informed the Commission and parties by letter that the timetable associated with the commencement of service to the Rosarito Power Plant had slipped by several months and, as a result, the previous need for a final Commission decision by October 1999 no longer existed. Ward noted that the timetable now envisioned by SoCal/SDG&E called for service to commence early in the year 2000. Bagley, attorney for California Water Association (CWA), met with Cmmr. Duque, in San Francisco. Also present were Tim Sullivan, advisor to Cmmr. Duque, and Izetta Jackson, attorney in the Commission's Legal Division. Bagley referred to the recent decision of the First District, California Court of Appeal in Hartwell v. Superior Court, in which the court dismissed a number of private lawsuits against Commission-regulated-water utilities which had alleged personal injuries resulting from the service by the utilities of allegedly contaminated water. Bagley stated that the court's decision was based on the Commission's exclusive jurisdiction over the terms and conditions of water service provided by the investor-owned water utilities. Bagley stated that the Commission should continue to assure that the water utilities are complying with all applicable water quality rules and regulations. Bagley further stated that such an on-going proceeding could be the venue for the Commission's periodically reviewing developments related to new water quality regulations, the identification of new contaminants, and the development of new testing and treatment techniques. Hyatt, in San Francisco. ORA addressed various claims made by Pacific Gas and Electric Company (PG&E) and the El Dorado Irrigation District (District) regarding the proposed transfer. Specifically, contrary to the request of PG&E that its electric ratepayers pay the District $17,000,000. ORA explained that the record of the hearing held establishes that the value of the El Dorado Project (Project) is $150,000,000. ORA recommends that the Commission either deny the application, so that a more reasonable price may be negotiated, or condition approval of the proposed transfer on the requirement that PG&E remove the net book value of the Project from its ratebase without corresponding adjustment to its Transition Cost Balancing Account. Summary: On September 10, 1999, Robert Finkelstein, staff attorney, for The Utility Reform Network (TURN), met with Michelle Cooke, advisor to Cmmr. Duque, in San Francisco. A handout was provided and attached to the notice. Finkelstein urged that neither the Draft Decision (DD) nor the Alternate Decision (AD) be issued without substantial changes. Finkelstein noted that based on the record as it existed prior to the filing of Southern California Edison (Edison) and the Office of Ratepayer Advocates (ORA) Joint Reply Comments, the Proposed Settlement would to demonstrable reductions in the amount of Other Operating Revenues that flowed to ratepayers under existing ratemaking mechanisms. Finkelstein also noted that both DD and the AD generally reject every substantive argument ORA had made in support of the reasonableness of the Settlement from ratepayers perspective. Finkelstein noted that the Reply Comments reversed the position of at least one of the Settling Parties on a core issued covered by the Proposed Settlement. While Finkelstein agreed that this was an incremental improvement, he contended that the Commission should be very troubled by the manner in which the change was made, and especially the fact that the Settling Parties claimed no change had occurred. Finkelstein suggested that since the support for the Proposed Settlement relied more on the credibility of the Settling Parties, that this should be further cause for the Commission to seriously reconsider the totality of the Proposed Settlement and as a result of that review, reject it.
