Stakeholder Roundtable on CPUC Innovations October 12, 1999 1 pm California Public Utilities Commission 505 Van Ness Avenue Auditorium San Francisco (Corner of Van Ness Avenue and McAllister Street) The Stakeholder Roundtable is a key element of our ongoing effort to assure that the way the California Public Utilities Commission (CPUC) conducts business is fully aligned with evolving publicly-valued needs and expectations. Federal and state utility deregulation, technological change, as well as other current issues with widespread impact including area code proliferation, local and long distance telephone competition, competition in electricity services, and the need for consumer education and protection in competitive industries. All of these make it imperative for the CPUC to continue to strive to address stakeholder and public needs in innovative and efficient ways. The goal of the Stakeholder Roundtable is to hear your suggestions for specific, feasible, needed innovations at the CPUC with respect to, for instance, changes in processes, rules, ways of conducting business, and ways we interact and communicate with the public and others. We also seek ideas from our employees on how we can make the Commission a more fulfilling place to work. Recently, the Commission issued its Draft 1999 - 2000 CPUC Business Plan for stakeholder review and comment (available at www.cpuc.ca.gov). Within it are ongoing process reform efforts, planned innovations in expanded electronic access to the CPUC, and additional planned streamlined procedures to benefit stakeholders and the public directly. The Draft Business Plan incorporates a set of eight good government initiatives I proposed this spring and the Directors' responses to an innovation survey conducted by the Governor's Office of Innovation in Government. These documents are available on the Commission website in association with this notice. The Stakeholder Roundtable is intended to go a step further by enabling us to hear firsthand from electric, telephone, and gas utilities and providers, rail, water, transportation, and other regulated entities. We also seek input from the public, consumer groups, industry labor representatives, legislators, the Administration, other government agencies, employee advocacy groups and employee union representatives about innovations or improvements you think we should make to better serve public and stakeholder interests, and how we should begin to implement them expeditiously. Areas for discussion might include, for example: New or evolving regulatory models for the Commission's regulatory, oversight, education, consumer protection, and enforcement roles; Communication, both to and from the Commission, and access to Commission information, focusing on ease of use, availability of information or employees, and the timeliness and value of available information; Electronic interfacing between the Commission and stakeholders, and e-business processes including the transferring information to and sharing of databases; The development of expert systems or automated processes for repetitive business processes; and Feedback mechanisms to continuously inform the Commission of a need to re-align its processes to address changing circumstances or enhanced technology. Hutchins Street Lodi Isleton Community Center 208 Jackson Boulevard Isleton The CPUC invites all interested agencies and the public to comment on the Draft Environmental Impact Report (EIR) for the Lodi Gas Storage Application. The Draft EIR can be viewed at the Sacramento, Lodi, Walnut Grove, Isleton, and Stockton Public Libraries. The deadline for submitting written comments on the Draft EIR is November 11, 1999. The CPUC released for public review and comment a Draft EIR for the project. Lodi Gas Storage, LLC, applied to the CPUC for approval to construct and operate a natural gas storage field near Lodi, California, and an approximately 33-mile pipeline in California's San Joaquin and Sacramento Counties. The Draft EIR contains environmental analyses and recommended mitigation measures for impacts that may occur if the project is approved. The CPUC's review analyzed topics such as agricultural, air quality, biological, and water resource impacts for the proposed pipeline and alternative routes. Two alternative routes follow public rights-of-way and an existing PG&E pipeline, and another alternative is a composite of all of the pipeline routes. If approved, the CPUC will grant Lodi Gas Storage, LLC, a Certificate of Public Convenience and Necessity. The proposed project includes a separation facility that removes the water from gas, 11 natural gas withdrawal/injection wells, three monitoring wells, a compressor and dehydration station, and a 33-mile pipeline. The natural gas pipeline would connect to PG&E's pipeline system. Lodi Gas Storage plans to use the storage and pipeline to respond to market demands and fluctuations in the price of natural gas. Blas‚ letter provided supplemental information to Pacific Bell's recent ex parte contacts pertaining to its Directory Assistance (DA) application. Blas‚ letter also focused on the key fact that the $.50 DA price is based on cost. Summary: On September 24, 1999, John Sumpter, Vice-President-Regulatory, of Pac- West Telecomm, Inc. (Pac-West), met with Lester Wong, advisor to Cmmr. Bilas, and Norman Low, advisor to Cmmr. Wood, in San Franciso. A copy of written materials was used and attached to the notice. Sumpter discussed two errors in the Draft Arbitrator's Decision. First, the decision finds that Pac-West did not negotiate in good faith. Sumpter stated, the issue of good faith negotiation was not raised in the matrix of unresolved issues submitted for arbitration. Sumpter noted that the testimony shows the Citizens Telecommunications Company of California, Inc.'s (Citizens) counsel informed Pac-West that an arbitration would be necessary to resolve the issue of reciprocal compensation. Second, Sumpter explained that the reciprocal compensation rate proposed in the draft decision was intended to be based on Pacific Bell's Total Element Long Run Incremental Cost rates for local switching, but the Draft Arbitration Decision overlooked the set-up element of Pacific Bell's rate in establishing the rate for Citizens, and as a result, the proposed rate is lower than Pacific Bell's costs and therefore, is not a reasonable approximation of Citizens' cost of terminating traffic. Finally, Sumpter explained that Pac- West supports the Draft Arbitration Decision's affirmation that reciprocal compensation applies to local Internet Service Provider traffic. Duque, Cmmr. Hyatt, and Cmmr. Wood, in San Francisco. Copies of the letter were also sent to their respective advisors, Norman Low, Fassil Fenikile, Robert Lane, Lester Wong, and Tim Sullivan. The letter replied to an earlier letter sent to the Commission by AT&T, dated August 26, 1999. Blas‚ noted in the letter that the proposed price for Pacific`s UNE loop was one of the lowest in the nation. Blas‚ also noted in the letter that AT&T's major theories is that the Commission should consider yellow page revenues and create a subsidy that AT&T should receive as a reduction in UNE loop prices.
