Federal and state utility deregulation, technological change, as well as other current issues with widespread impact including area code proliferation, local and long distance telephone competition, competition in electricity services, and the need for consumer education and protection in competitive industries. All of these make it imperative for the CPUC to continue to strive to address stakeholder and public needs in innovative and efficient ways. The goal of the Stakeholder Roundtable is to hear your suggestions for specific, feasible, needed innovations at the CPUC with respect to, for instance, changes in processes, rules, ways of conducting business, and ways we interact and communicate with the public and others. We also seek ideas from our employees on how we can make the Commission a more fulfilling place to work. Recently, the Commission issued its Draft 1999 - 2000 CPUC Business Plan for stakeholder review and comment (available www.cpuc.ca.gov). Within it are ongoing process reform efforts, planned innovations in expanded electronic access to the CPUC, and additional planned streamlined procedures to benefit stakeholders and the public directly. The Draft Business Plan incorporates a set of eight good government initiatives I proposed this spring and the Directors' responses to an innovation survey conducted by the Governor's Office of Innovation in Government. These documents are available on the Commission website in association with this notice. The Stakeholder Roundtable is intended to go a step further by enabling us to hear firsthand from electric, telephone, and gas utilities and providers, rail, water, transportation, and other regulated entities. Second Panel: e-PUC - Upgraded Web site and Electronic Business Processes (2:30 - 3:15 p.m.) The PUC was in the vanguard of California agencies establishing the first generation Internet web sites to provide information to the public and our stakeholders about activities of the agency. As the PUC passes through the Y2K era, we perceive a need to develop a web site which not only provides users access to our decisions and public records (pursuant to SB 779) but also creates a dynamic gateway into the PUC's business processes and knowledge base. What dynamic information about Commission activities is useful for regular users of the PUC web site? What static "library" of decisions and public records do web site users need? Assuming an electronic filing and service capability for PUC proceeding participants is needed, how should issues of security, confidentiality, and certification of service be addressed? What types of information would add value to consumer web site users? Should consumer education materials be interactive and/or multi-lingual? Should the PUC objectively compile and present comparison-shopping information on services subject to its oversight? Are there potential processing benefits from the secured sharing of databases between the PUC and service providers, including the PUC's processing of customer complaints? Due to legislatively perceived problems, additional rules and processes were added to the judicial model, making it at times inappropriately burdensome and lengthy. For participants in the fast-paced competitive marketplaces being processed in the regulatory regime, too much time results in opportunities lost. What alternatives to the traditional judicial model are available for the regulatory and policy-making processes of the PUC? How can the use of alternative dispute resolution processes be maximized? What safeguards can be built into less legalistic and more collaborative processes to assure open, fair and impartial policy-making and decision-making? Hutchins Street Lodi Isleton Community Center 208 Jackson Boulevard Isleton The CPUC invites all interested agencies and the public to comment on the Draft Environmental Impact Report (EIR) for the Lodi Gas Storage Application. The Draft EIR can be viewed at the Sacramento, Lodi, Walnut Grove, Isleton, and Stockton Public Libraries. The deadline for submitting written comments on the Draft EIR is November 11, 1999. The CPUC released for public review and comment a Draft EIR for the project. Lodi Gas Storage, LLC, applied to the CPUC for approval to construct and operate a natural gas storage field near Lodi, California, and an approximately 33-mile pipeline in California's San Joaquin and Sacramento Counties. The Draft EIR contains environmental analyses and recommended mitigation measures for impacts that may occur if the project is approved. The CPUC's review analyzed topics such as agricultural, air quality, biological, and water resource impacts for the proposed pipeline and alternative routes. Two alternative routes follow public rights-of-way and an existing PG&E pipeline, and another alternative is a composite of all of the pipeline routes. If approved, the CPUC will grant Lodi Gas Storage, LLC, a Certificate of Public Convenience and Necessity. The proposed project includes a separation facility that removes the water from gas, 11 natural gas withdrawal/injection wells, three monitoring wells, a compressor and dehydration station, and a 33-mile pipeline. The natural gas pipeline would connect to PG&E's pipeline system. Lodi Gas Storage plans to use the storage and pipeline to respond to market demands and fluctuations in the price of natural gas. Joseph explained why the proposed decision (PD) in Phase I was mistaken in its conclusion that the Incremental Cost Incentive Pricing (ICIP) for Diablo Canyon ends at the end of the rate freeze rather than the end of 2001. Joseph traced the history of the Diablo Canyon ICIP from the SONGS ICIP decision to the Preferred Policy Decision in 1995 to the PG&E Restructuring Rate Settlement, to AB 1890 and to Decision 97-05-088. Joseph further stated that there was a clear distinction between recovery of sunk costs and ongoing operating costs through the ICIP. Joseph stated that the PD does not distinguish between the utility CTC recovery that ends at the end of the rate freeze, and ICIP which is for ongoing costs, not recovery of CTC. Joseph urged the Commission to uphold the agreement of the settling parties and reaffirm that the ICIP continues through the end of 2001, regardless of when the rate freeze ends. Further, Richard stated that ICIP recovers ongoing costs, while Diablo Canyon transition cost recovery is for sunk costs. Richard stated Commission intended to provide nuclear plants with the opportunity for a certain transition to competition to minimize any resulting disruption to the power markets that the transition might cause. Finally, Richard stated that the proposed decision (PD) states that Diablo Canyon will go to market when the rate freeze ends, a point in time which may not be known until many months after rate freeze has occurred. Richard stated that the reference in the PD to the potential use of an "interim" valuation should be deleted. Richard further stated that the PD should be modified to limit the carryover constraint to transition cost recovery, leaving non-transition cost recovery subject to existing ratemaking. However, Sumpter noted that the testimony shows that at the first session, Citizens's counsel informed Pac-West that an arbitration would be necessary to resole the issue of reciprocal compensation. Sumpter stated, in the issue of good faith negotiation was not raised in the matrix of unresolved issues submitted for arbitration. Second, Sumpter explained that the reciprocal compensation rate proposed in the draft deicsion was intended to be based on Pacific Bell's TELRIC rates for local switching, but the Draft Arbitration Decision overlooked the set-up element of Pacific Bell's rate in establishing the rate for Citizens. As a result, the proposed rate is lower than Pacific Bell's costs and, therefore, is not reasonable approximation of Citizens's cost of terminating traffic.
