Public Meetings - CPUC Draft Environmental Impact Report First Meeting: October 13, 1999 Starts at 6 pm Second Meeting: October 14, 1999 Starts at 6 pm Hutchins Street Square 125 S. Hutchins Street Lodi Isleton Community Center 208 Jackson Boulevard Isleton The CPUC invites all interested agencies and the public to comment on the Draft Environmental Impact Report (EIR) for the Lodi Gas Storage Application. The Draft EIR can be viewed at the Sacramento, Lodi, Walnut Grove, Isleton, and Stockton Public Libraries. The deadline for submitting written comments on the Draft EIR is November 11, 1999. The CPUC released for public review and comment a Draft EIR for the project. Lodi Gas Storage, LLC, applied to the CPUC for approval to construct and operate a natural gas storage field near Lodi, California, and an approximately 33-mile pipeline in California's San Joaquin and Sacramento Counties. The Draft EIR contains environmental analyses and recommended mitigation measures for impacts that may occur if the project is approved. The CPUC's review analyzed topics such as agricultural, air quality, biological, and water resource impacts for the proposed pipeline and alternative routes. Two alternative routes follow public rights-of-way and an existing PG&E pipeline, and another alternative is a composite of all of the pipeline routes. If approved, the CPUC will grant Lodi Gas Storage, LLC, a Certificate of Public Convenience and Necessity. The proposed project includes a separation facility that removes the water from gas, 11 natural gas withdrawal/injection wells, three monitoring wells, a compressor and dehydration station, and a 33-mile pipeline. The natural gas pipeline would connect to PG&E's pipeline system. Lodi Gas Storage plans to use the storage and pipeline to respond to market demands and fluctuations in the price of natural gas. For questions about the meetings, contact the CPUC information line at 415/989-1446, extension 85. They are also available from the filing party who is under the obligation to provide copies of the notice without delay. 10/6/99 R93-04-003 Commission Order Instituting Rulemaking on Commission's own motion to govern open access to bottleneck services and establish a framework for network architecture development of dominant carrier networks and I93-04-002 Commission Order Instituting Investigation on the Commission's own motion into open access and network architecture development of dominant carrier networks.. Summary: On October 4, 1999, Richard B. Severy, Director, Public Policy, for MCI WorldCom, met Cmmr. Bilas, in San Francisco. Written materials were provided and attached to the notice. Also present were Lester Wong, advisor to Cmmr. Bilas; and William C. Harrelson, Senior Counsel, for MCI WorldCom. MCI WorldCom explained that the unbundled network element (UNE) prices contained in the administrative law judge's proposed decision (PD) and that competitors would have to pay greatly exceed Pacific Bell's (Pacific) retail rates against which competitors local exchange carriers would have to compete. MCI WorldCom also rebutted recent claims by Pacific that proposed conditions of the SBC/Ameritech merger would overcome objections to the uneconomic UNE prices contained in the PD. Severy explained that the promotional discount for UNE loops would not apply to loops used in combination with other UNEs, and would not be available for the most attractive market entry vehicle, "UNE platform." Severy further explained that the proposed conditions include additional restrictions that are unreasonable, limit the practical value of the discounted rate, and would have the effect of rationing competition. Summary: On October 5, 1999, William C. Harrelson, Senior Counsel, for MCI WorldCom, Inc. (MCI WorldCom), had a telephone communication with Bob Lane, advisor to Cmmr. Bilas, in San Francisco. Harrelson agreed to send by e-mail, information from the record in Open Access and Network Architecture Development showing how to reallocate common costs from residential loops to the other unbundled network elements. Harrelson followed up by e-mail and attached to the notice. Summary: On October 5, 1999, Bob Kargoll, Regulatory Director for AT&T Communications of California, In. (AT&T), engaged in two separate telephone conference with Bob Lane, advisor to Cmmr. Hyatt; with Lester Wong and Dorothy Duda, advisors to Cmmr. Bilas. During the call, Kargoll discussed AT&T concerns with Pacific Bell's (Pacific) proposed discounted Unbundled Network Element (UNE) loop price of $9.69. Kargoll pointed out that Pacific's discounted UNE loop proposal, which is part of the SBC/Ameritech merger conditions currently under evaluation by the Federal Communications Commission (FCC), does not apply in situations where a CLC leases a UNE loop and port combination. Finally, Kargoll recommended that the Commission hold-off voting on the proposed decision ALJ McKenzie in the Open Access and Network Architecture Development proceeding until the FCC has issued its decision in the SBC/Ameritech merger. Summary: On October 6, 1999, Francis E. Scott, Principal Deputy County Counsel, on behalf of the County of Los Angeles (the County), wrote a letter (attached to the notice) to Cmmr. Bilas, in San Francisco. Copies of the letter were also delivered to Cmmr. Hyatt, Cmmr. Neeper, Cmmr. Duque, and Cmmr. Wood. In the letter, the County expressed its strong support for the Commission's decision to halt the 424 overlay in the 310 area code region. In addition, the County stated that it is opposed to the introduction of any new area codes until such time as a comprehensive analysis of the area code situation ca be undertaken throughout the state. Finally, the County stated that it supports legislation such as Assembly Bill 406, now pending before the Governor, as well as other efforts that are consistent with the view of the Governor, as expressed in his letter to Cmmr. Hyatt dated September 15, 1999, and the view of the majority of the Commissioners in D.99-06-067. Summary: LATE FILED: On October 1, 1999, Jason Zeller, Counsel for the Office of Ratepayer Advocates (ORA), met with Cmmr. Duque, in San Francisco. Also present were Michelle Cooke, advisor to Cmmr. Duque; Robert Kinosian and James Price, for ORA; Dan Richards, Senior Vice President for Regulatory Affairs, Jana Corey, Diretor of Regulatory Relations, and Christopher Warner, Chief Counsel, for Pacific Gas and Electric Company (PG&E); Robert Finkelstein, Attorney, for The Utility Reform Network (TURN); Jeane Bennett and Mona Petrenko, for the Alliance for Retail Markets; Edward O'Neill, Attorney, for the California Power Exchange. ORA stated at the meeting that the proposed decision in Phase I of the Post Transition Ratemaking Proceeding had correctly rejected PG&E's position that the Incremental Cost Incentive Price (ICIP) should be continued to the end of the statutory transition period even if PG&E's rate freeze ends before the end of March 2002. As the decision correctly noted, ORA stated that PG&E itself proposed tying the end of the ICIP period to the end of the rate freeze in the application that led to D.97-05-088. ORA noted that if PG&E wants to challenge D.97-05-088, it should so via a petition to modify that decision, not through the aegis of the post transition ratemaking proceeding. ORA further noted that the decision's reliance on interim valuation as vehicle to estimate the value of PG&E's remaining generation assets is appropriate and will provide potential competitors with an idea of when PG&E's rate freeze will end. ORA also commented on PG&E's request to have a non-transition carry-over costs be recovered after the end of the rate freeze. ORA stated that PG&E had expressed concern about its alleged inability to recoup the cost of restructuring its system if a major earthquake hit its system before the end of rate freeze. Summary: On October 5, 1999, Thomas Long, Senior Telecommunications Attorney, of The Utility Reform Network (TURN) wrote a letter to Cmmr. Bilas, Cmmr. Duque, Cmmr. Neeper, Cmmr. Hyatt, and Cmmr. Wood, in San Francisco. The letter is hand-delivered and is attached to the notice. In the letter, Long explained the proposed decision (PD) failed to consider adequately how to ensure consistency with the aggregate approach to ratemaking that the Commission uses in telecommunications. The PD encourages requests for service-specific rate increases by failing to scrutinize Pacific Bell's costs studies, allowing undue mark-ups over the TSLRIC cost, and failing to order offsetting revenue decreases. The letter further stated that the PD thereby undermines the Commission's goals of promoting efficiency incentives, minimizing the cost of regulation, and promoting rate stability for customers. The PD fails to discuss TURN's concern about the adverse impact on the Commission's goals in telecommunications regulations. Summary: On October 8, 1999, Richard B. Severy, Director, Public Policy, for MCI WorldCom, wrote a letter (attached to the notice) to all Commissioners and advisors, in San Francisco. The letter addressed MCI WorldCom's conern that the ALJ's Proposed Decision (PD) contains recurring prices for unbundled network elements (UNEs) that are too high to permit competitors to enter the local telephone market to serve residential consumers on a financially viable basis. MCI WorldCom indicated that there are several reasonable alternatives that the Commission could adopt to overcome the untenable price squeeze created by the PD. MCI WorldCom recommended that the Commission allocate little or no recovery of common costs to the residential local loop. MCI WorldCom's letter also rebutted Pacific Bell's recent contention that pricing conditions associated with the SBC/Ameritech merger will overcome the unprofitable entry prospects of competitors who seek to serve residential customers by using combinations of UNEs.
