Hutchins Street Lodi Isleton Community Center 208 Jackson Boulevard Isleton The CPUC invites all interested agencies and the public to comment on the Draft Environmental Impact Report (EIR) for the Lodi Gas Storage Application. The Draft EIR can be viewed at the Sacramento, Lodi, Walnut Grove, Isleton, and Stockton Public Libraries. The deadline for submitting written comments on the Draft EIR is November 11, 1999. The CPUC released for public review and comment a Draft EIR for the project. Lodi Gas Storage, LLC, applied to the CPUC for approval to construct and operate a natural gas storage field near Lodi, California, and an approximately 33-mile pipeline in California's San Joaquin and Sacramento Counties. The Draft EIR contains environmental analyses and recommended mitigation measures for impacts that may occur if the project is approved. The CPUC's review analyzed topics such as agricultural, air quality, biological, and water resource impacts for the proposed pipeline and alternative routes. Two alternative routes follow public rights-of-way and an existing PG&E pipeline, and another alternative is a composite of all of the pipeline routes. If approved, the CPUC will grant Lodi Gas Storage, LLC, a Certificate of Public Convenience and Necessity. The proposed project includes a separation facility that removes the water from gas, 11 natural gas withdrawal/injection wells, three monitoring wells, a compressor and dehydration station, and a 33-mile pipeline. The natural gas pipeline would connect to PG&E's pipeline system. Lodi Gas Storage plans to use the storage and pipeline to respond to market demands and fluctuations in the price of natural gas. As part of that endeavor, the Energy Division will moderate an informational workshop where PG&E, SDG&E, and SCE will discuss their current ideas on how a demand responsiveness program may be structured for their full service customers. Summary: On October 8, 1999, Paul Stein, Staff Attorney, for The Utility Reform Network (TURN), wrote a letter (attached to the notice) to Cmmr. Bilas, Cmmr. Duque, Cmmr. Neeper, Cmmr. Hyatt, and Cmmr. Wood, in San Francisco. The letter addressed the treatment of Pacific Bell's proposed Centrex feature price increases in the Proposed Decision (PD) of the Administrative Law Judge. The letter stated that the PD would violate TURN's due process rights by finding that the cost of providing the services is not at issue, despite numerous previous rulings to the contrary. Finally, the letter stated that allowing rate increases due solely to inflation adjustments to Pacific Bell's price floors would subject ratepayers to excessive prices for Category II services and weaken the efficiency incentives built into the New Regulatory Framework. Summary: On October 12, 1999, Jason Zeller, Counsel for the Office of Ratepayer Advocates (ORA), met with Cmmr. Bilas, in San Francisco. Also present were Dorothy Duda, advisor to Cmmr. Bilas; Robert Kinosian, for ORA. ORA stated at the meeting that the proposed decision in Phase I of the Post Transition Ratemaking Proceeding had correctly rejected PG&E's position that the Incremental Cost Incentive Price (ICIP) should be continued to the end of the statutory transition period even if PG&E's rate freeze ends before the end of March 2002. As the decision correctly noted, ORA stated that PG&E itself proposed tying the end of the ICIP period to the end of the rate freeze in the application that led to D.97-05-088. ORA noted that if PG&E wants to challenge D.97-05- 088, it should do so via a petition to modify that decision, not through the aegis of the post transition ratemaking proceeding. ORA further noted that from a public policy perspective, the Commission should not continue to subsidize the operation of the Diablo Canyon Nuclear Plan by the payment of above-market prices for the electricity produced by the plant. ORA stated that the plant should be able to recover its on-going operating costs by selling its output to the power exchange similar to other power plants that do not have special incentive payment mechanisms. ORA further stated that the decision's reliance on interim valuation as a vehicle to estimate the value of PG&E's remaining generation assets is appropriate and will aid in the development of the competitive market in California. ORA also commented on PG&E's request to have a non-transition carry-over costs be recovered after the end of the rate freeze. ORA stated that PG&E had expressed concern about its alleged inability to recoup the cost of restructuring its system if a major earthquake hit its system before the end of rate freeze.
