Tobin, attorney for the County of Los Angeles (LA County), wrote a letter (attached to the notice) to Cmmr. Bilas, Cmmr. Duque, Cmmr. Neeper, Cmmr. Hyatt, and Cmmr. Wood, in San Francisco. The letter responded to a letter Pacific Bell (Pacific) sent to each Commissioner on September 21, 1999 and similar statements made by Pacific in other ex parte contacts with the Commissioners. LA County stated that to the extent that the Commission determine that a factual basis exists for the information contained in Pacific's September 21 letter and other ex parte communications, it must dismiss the application without prejudice and require Pacific to refile a new application that includes the arguments and "supporting" data it refused to provide during the hearings and now seeks to introduce after the record has been closed. LA County also addressed misstatements of fact contained in Pacific's September 21 letter. LA County stated that contrary to Pacific's allegation that the Commission has found overhead and common costs "on average to be 46% above incremental costs," no Commission decision reaches such a conclusion.
