As the decision correctly noted, ORA stated that PG&E itself proposed tying the end of the ICIP period to the end of the rate freeze in the application that led to D.97-05-088. ORA noted that from a public policy perspetive, the Commission should not continue to subsidize the operation of the Diablo Canyon Nuclear Plan by the payment of above-market prices for the electricity produced by the plant. ORA further noted that the plant should be able to recover its on-going operating costs by selling its output to the power exchange similar to other power plants that do not have special incentive payment mechanisms. ORA noted that the decision's reliance on interim valuation as vehicle to estimate the value of PG&E's remaining generation assets is appropriate and will aid in the development of the competitive market in California. ORA commented on PG&E's request to have a non- transition carry-over costs be recovered after the end of the rate freeze. ORA stated that PG&E had expressed concern about its alleged inability to recoup the cost of restoring its system if a major earthquake hit its system before the end of rate freeze. Rahon urged the Commission to consider four changes to the proposed decision (PD) of ALJ Gottstein. First, the El Paso surcharge from capacity relinquishments related to Pacific Gas and Electric Company and others should be allocated on the basis of the Core Market's El Paso reservation capacity. Second, the El Paso settlement refund should be allocated consistent with the El Paso surcharges. Third, the Year 2000 and 2001 Transwestern surcharges of $14 Million should be excluded from the proposed cost shift and recorded to the Interstate Transition Cost Surcharge Account when incurred. Fourth, the El Paso interstate pipeline credits should be allocated on the same basis as the El Paso surcharges. Rahon noted that the allocation methodology for the El Paso interstate pipeline credits is not opposed by any party. Finally, Lorenz concluded that adoption of the PD, as currently written, would effectively penalize Sempra's shareholders for taking steps to solve an industry problem of interstate capacity surplus. Finkelstein stated that the Commission should interpret the express language of the RRS as either undermining PG&E's current position, or as inherently contradictory and therefore as no help in the resolution of anyone's intent on the issue. Finkelstein addressed the utilities' arguments for allowing carry over of costs incurred during the rate freeze so that they might be collected after the rate freeze has ended. In addition, during the meeting with Cmmr. On the voicemail message, Waksman explained that GTEC has consistently refused to provide NEXTLINK with DS1's as unbundled elements (UNE), and will only provide such circuits as retail tariff offerings at prices far in excess of UNE-based pricing. Waksman stated that GTEC's blatant violation of its legal obligations is evidence that it is not appropriate to grant GTEC interim pricing flexibility at the present time.
