As the decision correctly noted, ORA stated that PG&E itself proposed tying the end of the ICIP period to the end of the rate freeze in the application that led to D.97-05-088. ORA noted that from a public policy perspetive, the Commission should not continue to subsidize the operation of the Diablo Canyon Nuclear Plan by the payment of above-market prices for the electricity produced by the plant. ORA further noted that the plant should be able to recover its on-going operating costs by selling its output to the power exchange similar to other power plants that do not have special incentive payment mechanisms. ORA noted that the decision's reliance on interim valuation as vehicle to estimate the value of PG&E's remaining generation assets is appropriate and will aid in the development of the competitive market in California. McManus stated that PG&E is concerned about the language on pages 13-15 of the proposed decision (PD) that suggests a limit to the non-transition costs that can be carried over beyond the end of the rate freeze. McManus further stated that PG&E believes that transition cannot be carried over beyond the end of the rate freeze, but that traditional ongoing ratemaking activities of the Commission are allowable for non-transition costs beyond the end of the rate freeze. McManus cited examples of non-transition cost accounts that might be precluded given the vagueness of the language in PD. McManus further stated that if the Commission intends for the utilities to recover these types of ongoing costs, then the language in the PD should be clarified. In addition, during the telephone conversation with Duda and Malcolm, McManus stated that she believes the discussion on pp. 13-15 of the PD is inconsistent with p. 23 of the PD which accepts PG&E's proposals for continuing distribution rate components contained in balancing account.
