Bilas, Duque, Hyatt, Neeper, and Wood, in response to The Utility Reform Network's (TURN) letter of October 9, 1999. In the letter, Pacific Bell (Pacific) states that TURN's letter misstates the facts and overlooks important industry developments which have occurred since the adoption of New Regulatory Framework. Approving Pacific's Directory Assistance application will not lead to a flood of price increase applications as TURN contends. Pacific directory assistance application deals with repricing a service that has always been priced below cost and the proposed decision (PD) correctly disposes of the issues revisited by TURN in it s letter. Bilas, Duque, Hyatt, Neeper, and Wood, a copy of a letter addressed to Thomas Long, Senior Telecommunications Attorney at The Utility Reform Network (TURN). The letter relayed Pacific Bell's (Pacific) concerns regarding inaccurate statements made by TURN in a letter signed by TURN's Executive Director, Nettie Hogue.. In the letter, Pacific maintains that the proposed price is necessary to recover its costs and a reasonable profit. Pacific never said or admitted that $.50 per call is far in excess of what is required to ensure cost recovery and return on investment. The text of Pacific's letter also points out that TURN argues that there is no real competition by attempting to discount existing competitive alternatives and reminds TURN that AT&T raised rates for other operator services without any protest from TURN. Severy reminded Wong that the proposed Unbundled Network Elements (UNE) prices do not permit financially viable entry for residential customers. Severy urged the Commission to modify the proposed decision by allocating no mark-up for shared and common costs to the UNE price for unbundled loops. (ICG), had a telephone communication with Bob Lane, advisor to Cmmr. Hyatt, in San Francisco. Notsund and Selby pointed out that the nonrecurring charges that CLECs must currently pay for unbundled network elements (UNEs) are substantially above what they would be based on Total Element Long Run Incremental Costs. Notsund and Selby stated that such a reallocation of shared and common costs among UNEs would risk tilting the competitive playing field, allowing some competitors to purchase some UNEs that bore a smaller percentage of such costs while forcing others to purchase UNEs that bore a higher percentage of such costs. Notsund and Selby further stated that such an approach would risk gaming the competitive process and would constitute picking winners and losers in an arbitrary manner. Bilas, in San Francisco. Lehtonen notified Wong that on September 10, 1999, Pacific Gas and Electric Company (PG&E) filed an Application requesting the Commission to allow Electric Lightwave, Inc. (ELI) to install and utilize fiber optic lines on PG&E transmission poles. Lehtonen stated that PG&E filed this application despite its opposition to claimed that its transference of operational control of transmission facilities would prevent, or hinder it from controlling access to its transmission poles.
