Summary: On November 5, 1999, Patrick Gileau, attorney for the Office of the Ratepayer Advocates (ORA), met with Michelle Cooke, advisor to Cmmr. Duque, in San Francisco. And on November 9, 1999, Jason Zeller, attorney for ORA, met with Cmmr. Neeper and David Gamson, advisor to Cmmr. Neeper, also in San Francisco. In both two meetings, Jonathan Bromson and Martin Lyons, for ORA; and Robert Finkelstein of The Utility Reform Network, participated. Gileau and Zeller indicated that they support the proposed decision (PD) of ALJ Wetzell. Gileau and Zeller also indicated that the combined recommendations of various parties would support a rate decrease. Gileau and Zeller noted that Pacific Gas and Electric Company (PG&E) has sought increases in the past that are from 2 to 9 times greater than what was found reasonable. Gileau and Zeller discussed that the PD grants all of PG&E estimates for safety and reliability other than in vegetation management. Gileau and Zeller also discussed that the PD increases this item by 76% whereas PG&E asks for 330%. Finally, Gileau and Zeller stated that this is a period of low inflation, low customer growth and one where the Legislature and Commission are attempting to lower rates. Neeper; Jason Zeller, Jonathan Bromson, and Marty Lyons, representing the Office of the Ratepayer Advocates. Finkelstein stated that TURN supports the adoption of the proposed decision (PD), as written, having come to the conclusion that it achieves on balance a fair and reasonable outcome. Finkelstein noted it provides Pacific Gas and Electric Company (PG&E) with increases of nearly 10% for electric revenues, and 8% for gas. Finkelstein urged the Commission to recognize that the PD represents the upper range of total revenue requirement amounts that could be deemed reasonable based on the record developed in the proceeding, and would ample resources to continue to adequate quality of service and reliability. Summary: On November 10, 1999, Jeanne Bennett, attorney, for Enron Corp. (Enron), had an equal-time meeting with Cmmr. Neeper, in San Francisco. Also present were David Gamson, advisor to Cmmr. Neeper; Mona Petrochko of Enron. Petrochko stated that Enron was very supportive of the proposed decision (PD) in Phase I of Pacific Gas and Electric Company's (PG&E) general rate case, especially in its recognition of the detrimental impacts on competition which would engender from a PG&E distribution revenue requirement set higher than that necessary to provide an adequate level of distribution service. Bennett pointed out certain minor points on which Enron believes the PD needs slight modification, including the establishment of specific forum, for which certain issues such as the recovery procurement costs and the further unbundling of the revenue requirement can be addressed. Neeper, Netie Hoge of The Utility of Reform Network (TURN), participated, and Mike Florio of TURN attended the meeting with Cmmr. Hyatt. In both two meetings also present were Jody London for Grueneich Resource Advocates, counsel for RCRC; Robert Kinosian of the Office of the Ratepayer Advocates; Guy Phillips of the Pacific Coast Federation of Fishermen's Associations, Diane Fellman, counsel for the Independent Energy Producers, and John Fistolera of the Northern California Power Agency. A copy of written materials were used and attached to the notice. Lujan stated that Hoge opened the meeting by explaining that the above groups have found common interests related to Pacific Gas and Electric Company's (PG&E) application to auction its hydroelectric system. Specifically, the group expressed its opinion that the Commission should open an order instituting investigation as a vehicle for conducting a valuation of PG&E's hydro system and broadening the scope of the proceeding to include consideration of non-price factors. Lujan stated that RCRC has been looking for data on water flow, storage, land use, and other issues to help craft a solution that can be of benefit to local communities and the state.
