Summary: On November 15, 1999, Leslie Everett, Vice President and Project Manager, Generation Divestiture, of Pacific Gas and Electric Company (PG&E), met with Cmmr. Hyatt, in San Francisco. Also present were Kim Malcolm, advisor to Cmmr. Hyatt; Dan Richard Jr., Senior Vice President, Public Affairs; and Roger Peters, Senior Vice President and General Counsel, for PG&E. Richard summarized the key elements of the PG&E's response filed on November 15, 1999, including the company's view that Assembly Bill 1890 does not provide for interim valuation of its hydroelectric generating assets; and that interim valuation of the company's hydroelectric generating assets without complete assurance that the valuation would be fully collected by the end of 2001 would require PG&E to take immediate write-off against earnings with no compensation in return. Richard stated that PG&E's approach throughout the proceedings will be to point out to the Commission the effect on asset value of different proposed auction protocols and other mechanisms, but that in many cases the company does not have an independent stake in the procedures the Commission chooses to implement. Everett stated that with respect to accomplishing the Commission's objective of completing these proceedings within the statutory time frames, the critical path item is the CEQA review. Everett also stated that the Commission should address the scope of that review and the associated legal issues at the outset of the proceeding to ensure that the schedule will be met.
