On November 22, 1999, Ann McLeod, Executive Director for the California Cogeneration Council (CCC), had a telephone communication with Dorothy Duda, advisor to Cmmr. Bilas. MacLeod stated that CCC agrees with the statement in the Proposed Decision (PD) that the Commission should not make any finding regarding whether San Diego & Electric Company's (SDG&E) auction will result in an assignment of any affected power purchase agreements (PPAs) or require the consent of any Power Seller; however the CCC believes that certain other statements in the PD may be read as being inconsistent with that conclusion. McLeod also stated that by allowing SDG&E to proceed with the auction despite the lack of persuasive evidence, the PD overlooks the Commission's responsibility to ensure that the auction is designed in a way that is likely to benefit ratepayers. McLeod stated that the success of the proposed auction depends on bidders identifying the potential benefits of either restructuring in existing PPA or developing new products and services that the Power Seller can provide to the market, and being able to realize these opportunities without additional cost or contingencies. McLeod also stated that the PD errs in failing to give each Power Seller a right of first refusal to buyout its PPA at the winning bid price in the auction.
