The investigation will also consider whether the Commission should enter any orders to ensure that a similar outage does not occur again. Parties have agreed to a series of workshops to consider recommendations for the prevention of a future such outage. Workshops will continue on February 9 and 10, 2000 at San Francisco City Hall with Workshop 3. Workshop 3 will address procedures, workplace practices, plus command and control. Workshop 4 will be held February 23 and 24, and will address maintenance and equipment failure, plus post maintenance and modification testing. Summary: On January 27, 2000, at 10:00 a.m., Bill Blase, President, Pacific Bell, who initiated this oral ex parte communication, met with Commissioner Lynch at the CPUC in San Francisco. A written handout (copy attached) was used during the communication. The purpose of the contact was to discuss Pacific Bell's concerns with the proposed Section 314.5 audit of Pacific Bell and to support Commissioner Duque's Revised Draft Decision. Mr. Blase reviewed the procedural history of this matter and also indicated there was extensive evidence to support the reassignment of the audit to the Telecommunications Division. Using the handout, he stated that extensive information (approximately 50,000 pages) was already provided in this and other proceedings and was available for review of affiliate transactions and other areas in the ORA proposed audit. Mr. Blase stated that this was a unique situation in that there are multiple instances where ORA's proposed audit scope has exceeded that ordered by the Commission. For the many reasons outlined in Commissioner Duque's Revised Draft Decision, he urged that Pacific Bell's Petition to Modify was timely filed and cited evidence that was not available until 1999. Finally, Mr. Blase noted that the performance of an audit of the books and records of Pacific Bell should be an objective review, which was not possible given the auditors selected by ORA. The audit should also comport with the scope of the statute and evaluate the books and records only of Pacific Bell. The Commission should select and entrust the management of this audit to a staff organization within the Commission that will be seen as objective and fair under the unique circumstances of this case. Mr. Finkelstein informed Commissioner Duque that TURN continued to support the adoption of the Proposed Decision ("PD") of ALJ Wetzell and urged rejection of the Alternate Decision ("Alternate") sponsored by Commissioner Wood.. He noted that the record evidence fully supported the PD, whereas the Alternate relies on assumptions and assertions that are either not found in the record, or that were disproven by far more compelling record evidence. He quoted several instances from the Alternate that established that PG&E had asked for too much. In each case, the Alternate would grant to PG&E the full amount it had requested. Mr. Finkelstein cited the Alternate's treatment of capital spending projects as the best example of the legal error built into the Alternate. He agrees with PG&E that one might normally expect PG&E's spending to be below forecasted levels in some areas and above those levels in others. However, for capital spending in 1998, PG&E had underspent by substantial amounts its forecasted levels across the board. And, PG&E had stated its expectation that its 1999 spending levels would be approximately the same as 1998 for capital projects. So, the Commission knows now, based on the record, that PG&E spent substantially less than was forecast for each of these years. To grant PG&E recovery based on the forecasted amount is not only legal error, but inconsistent with the Alternate's stated purpose of ensuring PG&E recovers what was spent on capital projects. Mr. Finkelstein pointed out that the path to a quick final resolution herein lies with the adoption of the PD, which is amply supported by record evidence and gives PG&E a $270 Million increase over what the level rates would be at today absent the General Rate Case ("GRC"). Adopting the Alternate invites further legal challenge due to the error built into its analysis and its general inconsistency with the record. Mr. Finkelstein suggested several steps the Commission should take, at a minimum, before adopting the Alternate. The primary step would expand the audit called for in the Alternate to include 1998 as well as 1999 spending and makes the rates resulting from the GRC subject to refund so the audit might be of more meaningful benefit to ratepayers. He noted that the record evidence fully supported the PD, whereas the Alternate relies on assumptions and assertions that are either not found in the record, or that were disproven by far more compelling record evidence. He stated that the Alternate disavows any interest in disallowing any cost that PG&E incurred for capital projects in 1998 and 1999. It would constitute legal error to give PG&E more than the Commission knows it spent in those years. At the very least, the audit called for in the Alternate should be expanded to include 1998 as well as 1999 spending. The rates should be subject to a refund so the audit might be of more meaningful benefit to ratepayers. Mr. Finkelstein urged Commissioner Neeper to avoid joining the Alternate's implicit treatment of the Section 368(e) spending as practices that should continue into the future. These funds were provided in the statute for 1997 and 1998 only. In the absence of any other action, distribution revenues would be reduced by $240 Million on January 1, 1999, due to the expiration of Section 368(e) authorization. The notion that PG&E would need similar funds in the future assumes that it will be engaged in catch-up forever rather than achieving some sort of steady-state operations once catch-up is achieved. The PD correctly recognizes that the catch-up period has ended. The Alternate would let it continue for another three years, contrary to the record evidence and the interests of customers of PG&E. On the issue of the Alternate's resuscitation of the attrition mechanism for PG&E, Mr. Finkelstein stated that while TURN understands that PG&E may see some upward pressures on certain costs, there will also be opportunities to achieve greater efficiencies to PG&E's operations. The further revenue increase in excess of $100 Million in 2001 seems less like an effort to address increasing cost pressures and more like an attempt to give PG&E more money without appearing to do so.
