Summary: On January 26, 2000, Barbara Snider, Counsel for Citizens Telecommunications Company of California, Inc., and Citizens Telecommunications Company of the Golden State (hereinafter collectively referred to as "Filers") telephoned ALJ Kenney seeking clarification of the information said ALJ wanted to have included in the Compliance filing which Filers were directed to file at the January 19, 2000 Pre- Hearing Conference. The Compliance filing was to be filed and served by January 28, 2000. Due to the scope of said telephone conversation, moving from procedural to substantive issues, ALJ Kenney requested that Ms. Snider summarize their discussion in an e-mail message to him with copies to all parties and that ALJ Kenney would similarly respond via e-mail to all parties. A copy of both Ms. Snider's e-mail to ALJ Kenney and the latter's response is appended hereto. The substance of the telephone conversation and e-mail transmissions was to determine more precisely what said ALJ intended to be included in the rate comparison filing for local exchange rates. Ms. Snider's e-mail summarized the services which should or should not be included in the filing and their e-mail messages confirmed which rates should be included. Summary: On January 21, 2000 @ 3:30 p.m., at the CPUC in San Francisco, an equal time meeting was held between Southern California Generation Coalition ("SCGC") who was represented by Norman Pedersen, Alex Goldberg (Williams Energy Services) and Robert Pettinato (Los Angeles Department of Water and Power) and Advisor, Kim Malcolm. Mr. Pedersen initiated the communication. The SCGC representatives urged that the Proposed Decision ("PD") mailed on January 11, 2000 herein be revised so as to eliminate the provision for a Sempra-wide rate that would apply to Electric Generation ("EG") customers on the Southern California Gas Company ("SoCalGas") and San Diego Gas & Electric Company ("SDG&E") systems. They contended that the Sempra-wide rate proposal deviated from the principle that rates should be cost-based. Furthermore, the proposal would be unfair in that costs that would be shifted from SDG&E EG customers would be assigned to SoCalGas EG customers rather than the supposed beneficiaries of the cost shift. They also urged that the Commission adopt SCGC's proposal to segment the rates applicable to the EG class and it was further urged that the Commission decide on the merits the issue of whether line 6900 expansion costs should be included in the SDG&E resource plan rather than the SoCalGas resource plan.
