Mr. Pedersen initiated the communication. The SCGC representatives urged that the Proposed Decision ("PD") mailed on January 11, 2000 herein be revised so as to eliminate the provision for a Sempra-wide rate that would apply to Electric Generation ("EG") customers on the Southern California Gas Company ("SoCalGas") and San Diego Gas & Electric Company ("SDG&E") systems. They contended that the Sempra-wide rate proposal deviated from the principle that rates should be cost-based. Furthermore, the proposal would be unfair in that costs that would be shifted from SDG&E EG customers would be assigned to SoCalGas EG customers rather than the supposed beneficiaries of the cost shift. They also urged that the Commission adopt SCGC's proposal to segment the rates applicable to the EG class and it was further urged that the Commission decide on the merits the issue of whether line 6900 expansion costs should be included in the SDG&E resource plan rather than the SoCalGas resource plan. Summary: On January 27, 2000, @ 1:45 p.m., at the CPUC in San Francisco, Marc P. Fairman, attorney for Alisal Water Corporation, ("Alisal") initiated this oral ex parte communication with Timothy J. Sullivan, Advisor to Commissioner Henry N. Duque. Initially, Mr. Fairman described the background of this matter. He then described the circumstances under which the San Francisco Superior Court ordered Alisal to file the Application. Mr. Fairman believes that the Superior Court declined to enforce the judgment based on Alisal's showings that, under the Public Utilities Code, it could not be enforced without prior review and authorization from the Commission. Specifically, enforcement of the judgment could not be reconciled with existing Supreme Court authority under which the Superior Courts lack the jurisdiction to adjudicate claims that are foreclosed by Commission rules or implicate its policies. He expressed the view that the Commission has ample authority to review and decide the Application and that, in doing so, need not relitigate the issues adjudicated in the Monterey Superior Court. Rather, the Commission need only review the nature and background of the claims Silverwood raised in the Superior Court action to determine whether those claims abrogated Commission rules or policies. The Commission's findings of facts and conclusions of law would be limited to a finding that it will not authorize enforcement of the judgment because it is in conflict with its own rules and policies. A ruling to that effect would lay the predicate for a petition for review seeking a determination from the Supreme Court on the ultimate question of whether the Monterey Superior Court Judgment is void for want of the Superior Court's jurisdiction. Summary: Bill Blase, President, Pacific Bell, initiated a contact with Commissioner Lynch by causing to be delivered to her at the CPUC in San Francisco his letter dated January 28, 2000, a copy of which , including all attachments, is appended hereto. The purpose of said letter was to provide Commissioner Lynch with background and material facts relevant to the current dispute around ORA's proposed Section 314.5 audit of Pacific Bell. The salient points of Mr. Blase's letter and attachments were that the advocacy audit which ORA seeks to perform goes well beyond the statute and is not in compliance with the Commission's specific directives. The audit that the Commission ordered was an independent audit of the books and records on an accounting basis, not an advocacy audit. By Commission order, lengthy policy discussions were not considered to be properly part of the audit. As demonstrated in an attached summary and attached, highlighted (underlined) copies of ORA's RFP and Overland Consulting's audit proposal, the advocacy audit that ORA proposes goes well beyond the scope of the audit that the Commission ordered. Mr. Blase's letter also provided highlighted sections from Decision 96-05-036 and copies of two previous correspondences with the Commission (both of which were timely reported as ex parte communications) on this matter in the form of a letter dated July 13, 1999 from J.W.
