Contact: Jody Smith Phone: (202) 383-0113 2/10/00 I87-11-033 Commission investigation into alternative regulatory frameworks for local telecommunications exchange carriers, Summary: On February 7, 2000, Bill Blase, President, Pacific Bell, initiated a written ex parte contact with Commissioner Bilas and his Advisors, Dorothy Duda and Lester Wong, by causing to be delivered to them at the CPUC in San Francisco a transmittal note and a copy of a letter and attachments sent to Commissioner Lynch on January 28, 2000, copies of which are attached. Said letter was sent to Commissioner Lynch to provide her with background and material facts relevant to the dispute around ORA's proposed Section 314.5 audit. One of the points made in said letter was that the advocacy audit which Ora seeks to perform goes well beyond the statute and is not in compliance with the Commission's specific directives, which ordered an independent audit of the books and records on an accounting, not advocacy, basis. The letter to Commissioner Lynch also highlighted sections of Decision 96-05-036 and copies of two previous correspondences with the Commission. One letter was dated July 13, 1999 from J.W. Callaway, President, Pacific Telesis Group, to Commissioner Hyatt and the other, a letter dated July 22, 1999 from Bill Blase to Commissioner Hyatt. Mr. Callaway's letter expressed concerns with the proposed audit and asked that no audit be conducted because (1) The Commission has exempted most providers from this requirement; (2) the scope of the audit goes well beyond the guidelines set forth in Decision 96-05-036 and Section 314.5; (3) Ora and its selected contractors cannot be objective in that they have repeatedly taken positions adverse to Pacific Bell in the past; and (4) if an audit should be performed, it should be done by the Telecommunications Division. Mr. Blase's letter of July 22, 1999 and attachments stated that (1) a Section 314.5 audit of Pacific Bell's books and records does not serve the public interest in that said records are already audited by a major independent accounting firm annually; (2) The Commission has exempted most telephone companies from the requirement of an audit, including competitors; and (3) if an audit should be performed, that should be done by the Telecommunications Division. Representatives of SDG&E stated that although the PD correctly approved SDG&E's settlement with ORA, it inappropriately assumed that SDG&E should have known what its power plants would sell for long before they were actually sold. They noted that SDG&E filed its application to sell these power plants only two weeks before the start date of the Transition Cost Balancing Account ("TCBA") and this issue was not the subject of any evidence herein. Specifically, the PD orders SDG&E to use an estimated market value equal to the book value of the plants and to modify, retroactively, the interest that has accrued since 1998. If the market value were equal to the book value of the power plants, there would have been no uneconomic costs to flow into the TCBA. SDG&E agrees with ORA's comments on the PD, and with statements made by ORA and PG&E that taking the actions ordered by the PD would likely result in harm to ratepayers.
