ALJ Ruling in R.94-04-031 (January 12, 1996)

ADMINISTRATIVE LAW JUDGE'S RULING

PROVIDING NOTICE OF PROPOSED REVISION TO SERVICE LIST

The service list to this proceeding is voluminous and reflects the broad interest and participation by the stakeholders to the policy aspect of the rulemaking and its companion investigation (R.94-04-031/I.94-04-032). The Commission has issued its policy decision (Decision 95-12-063) in electric restructuring and parties will shortly begin working on preliminary implementation details. As the Commission moves forward in electric restructuring, it is appropriate to update the service list. Many parties may be interested only in the broader policy issues.

Consistent with Rule 5(f) of our Rules of Practice and Procedure (California Code of Regulations, Title 20), this ruling provides notice of my intent to revise the service list to this proceeding. No later than January 31, 1996, all parties who wish to remain on the official service list to R.94-04-031/I.94-04-032 shall, by letter, so notify the Commission's Process Office and Administrative Law Judge (ALJ) Minkin (Room 5021, 505 Van Ness Ave., San Francisco, CA 94102).

Parties who wish to remain on the service list, but who prefer to receive Commission decisions and rulings by electronic mail (e-mail), rather than postal mail, should notify me of this preference and provide the Commission's Process Office and ALJ Minkin with their e-mail addresses. Parties who choose this option will be notified by e-mail of the availability of these documents and provided with instructions for accessing the documents. The documents themselves will not be sent by e-mail, but will be available for retrieval through FTP (file transfer protocol). The Commission will not disclose the e-mail addresses of any party selecting this option.

The Commission's service lists are generally divided into two broad categories. "Appearances" or "Interested Parties" is the more active category of the service list, that is, these parties will be served with all documents filed by all other parties on the service list and with all documents issued by the Commission. Parties who choose to remain on the service list who wish to be served electronically may also notify me of their consent to receive service from other parties by e-mail (Rule 5(b)). For these parties, the revised service list will disclose their e-mail addresses and indicate their willingness to receive e-mail service.

The other service list category is termed "Information Only." Parties who request Information Only status receive Commission decisions, rulings, and notices in our proceedings, but are not served by other parties. These parties are billed for Commission decisions at a charge of 20 cents per page. Those parties in the Information Only category who wish to receive Commission documents by e-mail will not be charged. Those parties who wish to shift to e-mail service in the Information Only category should so notify the Commission, as described above.

Any party who does not respond to this ruling by January 31, 1996 will be deleted from the service list. The revised service list will be issued with the forthcoming implementation roadmap proposed decision in this docket.

Therefore, IT IS RULED that:

1. No later than January 31, 1996, all parties who wish to remain on the official service list to R.94-04-031/I.94-04-032 shall, by letter, so notify the Commission's Process Office and ALJ Minkin.

2. Those parties who wish to receive Commission decisions and rulings by e-mail shall provide their e-mail addresses to the Commission's Process Office and ALJ Minkin.

3. Parties who choose to remain on the service list and who consent to receive service from other parties by e-mail shall notify the Commission's Process Office and ALJ Minkin. The revised service list shall disclose these e-mail addresses.

4. Any party who does not respond to this ruling by January 31, 1996 shall be deleted from the service list to R.94-04-031/I.94-04-032.
