All CMRS carriers are exempt from filing for preapproval of transactions involving issuance of stock and other securities, ownership transfers, and purchases of other CMRS property, with three exceptions: a) The financing of a CMRS affiliate by a local or long distance carrier (or their affiliates); b) purchase of an ownership interest in a CMRS by a local or long distance company; and, c) an ownership transfer where a controlling interest is acquired. CMRS include cellular services, personal communication services (PCS), wide-area specialized mobile radio services (SMR), and paging services. CMRS companies must still make an informational filing under the Wireless Registration procedures of the CPUC to report any changes in ownership of a CMRS within five days of such changes taking effect. CMRS providers need not file applications or advice letters for authority to carry out exempt transactions and any now pending will be dismissed. Because the regulation of cell siting is under review in a separate proceeding, the Commission deferred any action until a decision is reached in that case. Meanwhile, all CMRS carriers are generally exempt from filing for a permit for new construction, although an -more- informational filing is still required. Otherwise, cellular carriers must continue to follow standing rules with regard to cell siting and noncellular CMRS carriers must follow interim procedures to be set by the CPUC and make an informational filing regarding site location, Call Sign, and frequency within 15 days after obtaining local approval for construction, removal, or change of each site. -###-
