TEAM D REPORT ON CONSUMER PRIVACY

No report at this time. Concerns were raised that no closure on rules for   
aggregators can be reached without an understanding of subgroup D's
conclusions on consumer privacy.

DEFINITION OF CLOSURE ON ISSUES

The subgroup agreed to the following characteristics of closure:
identification of areas of consensus and options where no consensus
exists, and no further discussion in subgroup meetings. Further work to
develop consensus should be done off-line. A need was identified for a
mechanism to consolidate the Market Rules draft on each sub-issue.

AGGREGATION

After a discussion of PG&E's draft outline, several parties agreed to
collaborate on drafting the aggregation section of the Market Rules
section of the DAWG report. DGS agreed to re-draft the outline and
discuss with interested parties off-line. Topics will include items   
unique to aggregation, issues raised by the CPUC decision, and linkages to
other restructuring issues.

LOAD PROFILING

Offered for discussion were papers from CEC and CMA. Issues raised
included: defining the customer size cutoff point for load profiles, the
number of profiles to offer, and the means by which load profiles should
be developed and maintained. Several parties agreed to collaborate on
drafting the section of the DAWG report on load profiling.

OBLIGATION TO SERVE/COST RESPONSIBILITY

Comments on these papers are due to SDG&E. Issue otherwise closed.

REGULATORY JURISDICTION

CEC led a discussion of its draft on the subject. Questions were raised
as to the subgroup's ability to address this issue. The CEC was
requested to perform a gap analysis. Comments on issue relevancy and
scope due to CEC.

FRANCHISE FEES

CMA described a proposal in which franchise fee collection would be
handled similar to the gas model. Default collector would be the UDC,
subject to tariffs. Customers could opt out by agreement with the   
affected agencies. A write-up will be submitted to the subgroup for further
comment.

CODES OF CONDUCT

Subgroup should review CEC draft for discussion at next meeting.
Potential for combination of this issue with Regulatory Jurisdiction was
identified.
