Objection to Language that UDCs may Review MSPs' Work



Michele, 

CellNet objects to the language contained in the below documents that
"MSP's work can be reviewed by the UDCs" This suggests an enforcement role
by the UDCs. If fact, the UDCs are asking in a Petition to Modify that the
CPUC recognize that UDCs are NOT responsible for ensuring MSP performance
(unless the MSP is a subcontractor to the UDC); ESPs are responsible.

Further, this language is inappropriate given that the purpose of these
sections is to establish worker qualifications, not enforcement of MSPs
meeting performance or any other CPUC standards. It is important that
enforcement be considered as part of overall enforcement issues, which is
primarily a DQIWG issue and, to some extent, a Rule 22 issue (since Rule 22
includes enforcement and auditing provisions).
